These terms and conditions (“Terms”) govern your use of the website https://www.nightstonefragrances.com (“our Site”), your purchase of products from us, and form a legal agreement between you (“you/your/customer”) and Nightstone Fragrances (“we/us/our”).

By accessing or using our Site and/or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.

We reserve the right to refuse service or cancel orders where eligibility requirements are not met.

3. Ordering & Products

All products and prices are subject to availability. We reserve the right to withdraw or amend products at any time without notice.

We make every effort to ensure that:

Product descriptions are accurate;
Images reflect the product as closely as possible

However, variations may occur due to manfacturing or display settings.

Our products are not to be mistaken for, not affiliated with, any other brand. Product images are for illustration purposes only and may differ from the actual product received. Colors on some items, in particular (but not limited to), cosmetic items, may vary due to limitations within the photographic process and screen variations.

3.1 Placing an Order

To place an order, you must provide:

A valid delivery address in the UK (unless otherwise stated)
Contact details (name, email, telephone)
Payment information

All orders are subject to acceptance by us. We reserve the right to

Cancel any order at our discretion
Limit quantities purchsed
Cancel orders where pricing or product errors occur

If we cancel your order, you will receive a full refund.

3.2 Order Confirmation

Once an order is placed, we will send an order confirmation email. This email is an acknowledgement of receipt, not acceptance of your order. A contract is formed when we dispatch the products to you.

Orders may be subjected to extra security checks at our discretion. This may include confirmation of Credit/Debit card details, PayPal details, or full address details. Nightstone Fragrances reserves the right to request payment by an alternative method or cancel any orders if this information cannot be supplied.

3.3 Pricing

All Prices are listed in GBP (£) and include VAT where applicable. We reserve the right to amend prices without notice. Your card will only be charged once your order is accepted.

4. Payment

We accept major debit/credit cards and such other payment methods as displayed on our Site. Nightstone Fragrances will not be liable for charges or payment processing fees, should they apply, associated with your chosen method of payment.

Payments are processed securely. You agree to provide accurate and complete payment information. You authorize us to charge all amounts due to your chosen payment method.

5. Delivery

Delivery Times: Delivery times are estimates. While we aim to deliver within the specified timeframe, delays may occur.
Risk & Title: Risk transfers to you when the product is delivered. Ownership passes to you when we receive full payment.
Failed Delivery: If delivery fails due to your unavailability, additional charges may apply for re-delivery.

6. Returns, Cancellation & Refunds

Consumer Rights: Under UK consumer law, you have the right to cancel your order within 14 days from receipt of goods without giving any reason. To exercise this right, you must notify us by email before the expiry of the cancellation period. If you decide yo cancel or change your mind and without giving us a reason, and without liability, you must return the goods in undamaged and unused condition at your own expense.
Return Procedure: Returns must be unused, in original packaging and in a resaleable condition. You are responsible for return shipping unless the goods are faulty or damaged.
Refunds: Refunds will be issued within 14 days of receiving the returned goods or proof of return.
Faulty Goods: If a product is faulty or not as described, you are entitled to a replacement or refund in accordance with UK law.

7. Intellectual Property

All content on this Site, including text, graphics, logos, images, branding, design and software, is the property of Nightstone Fragrances and is protected by intellectual property laws. No other use is permitted without our written consent.

Nightstone Fragrances products are not to be confused with the products of any other companies they may be compared to. We have no affiliation, connection, or association with any designer brands or manufactures and/or designers. Our fragrances are not replicas, nor do we use to rebottle any other brand’s fragrances. We operate in competition with designer brands but remain a separate and distinct entity.

All trademarks, brand names, and copyright mentioned remain the property of their respective owners, manufactures, and/or designers.

We confirm that our business practices comply with the Trade Marks Act 1994 and all applicable UK legislation relating to fair completition and comparative advertising.

8. Website Use

You agree not to:

Use the Site unlawfully or in a way that could harm
Interfere with Site functionality
Upload malicious software or spam

If at any time we suspect fraudulent account activity or behavior we reserve the right to suspend, restrict or terminate your access to the website at any time without notice.
