These terms and conditions (“Terms”) govern your use of the website https://www.nightstonefragrances.com (“our Site”), your purchase of products from us, and form a legal agreement between you (“you/your/customer”) and Nightstone Fragrances (“we/us/our”).
By accessing or using our Site and/or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.

2. Eligibility
You confirm that:
- You must be at least 18 years of age to purchase products from our Website. If you are under 18, you may only place an order with the involvement and permission of a parent or legal guardian.
- You have legal capacity to enter into these Terms
We reserve the right to refuse service or cancel orders where eligibility requirements are not met.
3. Ordering & Products
All products and prices are subject to availability. Prices may change without notice but such changes will not affect orders already accepted.
We reserve the right to withdraw or amend products at any time without notice.
We make every effort to ensure that:
- We make reasonable efforts to ensure product descriptions, photographs and pricing are accurate.
- Images reflect the product as closely as possible
However, variations may occur due to manufacturing or display settings. Product images are for illustration purposes only and may differ from the actual product received. Colors on some items, in particular (but not limited to), cosmetic items, may vary due to limitations within the photographic process and screen variations.
Our products are independently manufactured cosmetic products and are not manufactured by, affiliated with, endorsed by, sponsored by or connected with any designer fragrance house or brand.
3.1 Placing an Order
To place an order, you must provide:
- A valid delivery address in the UK (unless otherwise stated)
- Contact details (name, email, telephone)
- Payment information
All orders are subject to acceptance by us. We reserve the right to
- Cancel any order at our discretion
- Limit quantities purchased
- Cancel orders where pricing or product errors occur
If we cancel your order, you will receive a full refund.
3.2 Order Confirmation
Once an order is placed, we will send an order confirmation email. This email is an acknowledgement of receipt, not acceptance of your order. A contract is formed when we dispatch the products to you.
Orders may be subjected to extra security checks at our discretion. This may include confirmation of Credit/Debit card details, PayPal details, or full address details. Nightstone Fragrances reserves the right to request payment by an alternative method or cancel any orders if this information cannot be supplied.
3.3 Pricing
All Prices are listed in GBP (£) and include VAT where applicable. We reserve the right to amend prices without notice. Your card will only be charged once your order is accepted.
4. Payment
We accept major debit/credit cards and such other payment methods as displayed on our Site. Nightstone Fragrances will not be liable for charges or payment processing fees, should they apply, associated with your chosen method of payment.
Payments are processed securely. You agree to provide accurate and complete payment information. You authorize us to charge all amounts due to your chosen payment method.
5. Delivery
- Delivery Times: Delivery times are estimates. Delivery estimates are provided in good faith but are not guaranteed unless expressly stated otherwise delays may occur.
- Risk & Title: Risk transfers to you when the product is delivered. Ownership passes to you when we receive full payment.
- Failed Delivery: If delivery fails due to your unavailability, additional charges may apply for re-delivery.
5.1 Lost or Delayed Parcels
If your order has not arrived within the expected delivery timeframe, please contact us as soon as possible so that we can investigate with the courier. Where a parcel is confirmed as lost in transit, we will, at our discretion and in accordance with your statutory rights, provide a replacement or issue a full refund. We are not responsible for delays caused by circumstances beyond our reasonable control, such as severe weather, industrial action, or courier disruptions, but we will make every reasonable effort to assist in resolving any delivery issues.
6. Returns, Cancellation & Refunds
- Consumer Rights: Under UK consumer law, you have the right to cancel your order within 14 days from receipt of goods without giving any reason. To exercise this right, you must notify us by email before the expiry of the cancellation period. If you decide to cancel or change your mind and without giving us a reason, and without liability, you must return the goods in undamaged and unused condition at your own expense.
Under the Consumer Contracts Regulations 2013, consumers have 14 days from receipt of goods to notify us of cancellation and a further 14 days to return the goods.
- Return Procedure: Products must be returned in a condition suitable for resale and that deductions may be made for diminished value caused by handling beyond what is necessary. You are responsible for return shipping unless the goods are faulty or damaged.
- Refunds: Refunds will be issued within 14 days of receiving the returned goods or proof of return.
- Faulty Goods: If a product is faulty or not as described, you are entitled to a replacement or refund in accordance with UK law.
7. Hygiene & Cosmetic Products
For hygiene reasons, cosmetic products that have been opened, used or where the protective seal has been broken cannot be returned unless faulty or not as described.
8. Product Sensitvity Warning
We recommend performing a patch test before applying fragrance oils or scented products.
Discontinue use immediately if irritation occurs. All products should be stored in a cool, dry place away from direct sunlight and excessive heat.
9. Allergy Disclaimer
Customers are responsible for reviewing ingredient information where provided and ensuring products are suitable for their personal requirements.

10. Cosmetic Product Safety
All Nightstone Fragrances products are cosmetic products intended solely for external use and should be used in accordance with the instructions provided on the product packaging.
- Products should be stored in a cool, dry place away from direct sunlight.
- Avoid contact with eyes.
- Do not apply to broken or irritation skin.
- Keep out of reach of children.
- Discontinue use if irritation occurs.

We confirm that our business practices comply with the Trade Marks Act 1994 and all applicable UK legislation relating to fair completition and comparative advertising.

Natural fragrance materials may vary slightly in colour between production batches without affecting product performance or quality.
20. Cosmetic Products
All cosmetic products sold by Nightstone Fragrances are assessed for safety in accordance with the requirements of the UK Cosmetics Regulation before being placed on the UK market.

Product descriptions, fragrance notes, longevity and scent impressions are provided as general guidance only. Fragrance performance may vary depending on skin chemistry, storage conditions, environment and method of application.
